1. General Provisions

All services provided by www.kosser.ch to the customer are exclusively subject to these General Terms and Conditions.
Different provisions shall only apply if they have been agreed upon in writing between www.kosser.ch, the customer, or the reseller.

The offers presented on the www.kosser.ch website represent an online store that allows customers to directly order the listed products.

By placing an order on our website, the customer enters into a purchase contract with KOSSER SA.
By accepting these conditions, the customer confirms that they are at least 16 years old. A copy of an identity document may be requested.

2. Delivery

• Orders are processed and shipped within 24 to 48 hours (business days), subject to product availability.

• Orders placed on weekends are processed on Monday.

• Delivery is made exclusively within Switzerland, with an average delivery time of 1 to 3 business days.

• In case of temporary unavailability of an item, the customer will be notified by email.

In the event of delivery delays due to force majeure, traffic disruptions, or government decisions, no compensation claims can be made.
Swiss Post tracking information shall be deemed authoritative.

3. Payment

• All prices are final, VAT included.

• Goods remain the property of KOSSER SA until full payment has been received.

• In case of late payment, administrative and reminder fees may be charged.

• Postal fees related to payments are at the customer's expense and non-refundable.

• For partial payments, shipping will only take place once the total balance has been paid.

4. Returns and Right of Withdrawal

Unused and unopened items may be returned in their original packaging within 7 days of delivery.
Return shipping costs are the responsibility of the customer.
Please contact us in advance via the contact form before returning any items.

Instructions regarding the right of withdrawal and its consequences form an integral part of these terms.

5. Warranty and Liability

• Any visible transport damage must be reported immediately to the carrier.

• Other defects must be reported in writing within 3 days of receipt.

• KOSSER SA is not liable for damages resulting from improper use, normal wear and tear, or external causes.

Hookah Bases

Hookah bases are not covered by warranty.
They are inspected in the customer’s presence at the time of purchase, but no exchange or refund will be accepted in case of breakage after purchase, as these are fragile items subject to damage.

The customer agrees to use all products safely and in compliance with the law.
KOSSER SA reserves the right to refuse sale or service in case of non-compliance with these terms.

6. Limitation of Liability

www.kosser.ch is not liable for indirect damages, loss of profit, or other financial losses.
Personal liability of employees, representatives, and agents is likewise excluded.

These limitations do not apply in cases of intent, gross negligence, or personal injury.
In the event of replacement, the customer must return the defective goods within 30 days at their own expense.

Customer personal data is used solely for order processing and treated confidentially.
However, KOSSER SA reserves the right to verify such data for security or creditworthiness purposes.

Login credentials provided to the customer must remain strictly confidential; KOSSER SA declines any liability in case of misuse.

8. Copyright

All logos, texts, photos, and graphic elements on the website are protected by copyright.
Any reproduction, distribution, or use without written authorization is strictly prohibited.

9. Validity and Jurisdiction

Every order implies acceptance of these General Terms and Conditions of Sale.
If any clause proves invalid, the remaining provisions shall remain valid.
The place of jurisdiction is the registered office of KOSSER SA, under Swiss law.

10. Display Error (0.00 CHF)

In case a price of 0.00 CHF or an obviously incorrect amount appears, this constitutes a technical error.
Such a display does not represent a valid contractual offer.

KOSSER SA reserves the right to cancel any affected order, even after automatic confirmation.
The customer will be promptly informed and may:

• confirm the order at the correct price, or

• cancel it without any charge.

Any commercial compensation remains at the sole discretion of KOSSER SA.
